General Terms and Conditions (GTC)

1. Scope, contracting party and contact
1.1 Contracting party. These General Terms and Conditions (GTC) govern the services of easyall GmbH, Stäffiserweg 13, 4500 Solothurn, Switzerland, email: info@easyall.ch (hereinafter “easyall” or “we”), on the easyall.ch platform.
1.2 Only for persons resident in Switzerland. Our intermediation, termination, cashback and referral services are aimed at persons resident in Switzerland. We accept applications only for persons resident in Switzerland, but not for persons resident abroad, for example cross-border commuters.
1.3 Applicability. These GTC apply to you as soon as you accept them by clicking when opening a customer account or when submitting an application. For an application, the version you accepted when submitting it applies (section 11.3). If you use the website without a customer account, please note sections 2 and 3.
1.4 Other documents. The Initial Information under Art. 45 of the Insurance Supervision Act (VAG) informs you about us as an insurance intermediary and about our compensation. The Privacy Policy explains how we process personal data. Your insurance contract is governed by the insurer's contract terms.
2. Services, limits and costs
2.1 Our services. On easyall.ch, easyall offers in particular:
- Comparison calculator and recommendation: comparison of the premiums for basic insurance (Health Insurance Act, KVG) and supplementary insurance (Insurance Contract Act, VVG) of the insurers included, and a recommendation that easyall produces from your details according to its own fixed rules.
- Insurance intermediation: submission of your application to the chosen insurer via the platform (section 4).
- Termination service: at your request, the termination of your current insurance (section 7).
- Cashback programme: a share in our commission if you take out supplementary insurance through us (section 5).
- Referral programme: a bonus for recommending the platform (section 6).
- AI assistants and policy import: the chat assistant, the companion “easy” and the AI-supported reading of your current policy (section 3.5).
- Doctor search in the application: for insurance models with a choice of family doctor or practice, a general directory of names and addresses of doctors and practices that is based on one insurer's network data; it helps you to state your family doctor's practice in the application (section 2.6).
- Premium alert: a free email notification when the new premiums are available. You can unsubscribe from it at any time via the link in every email.
- Customer account: an overview of your applications and documents (e.g. the advisory record), of cashback and referrals, and messages to us.
2.2 Costs and compensation. Our services are free of charge for you. easyall is compensated by the insurers for the intermediation. We disclose the nature and extent of this compensation, including the basis of calculation and the ranges, in the Initial Information; on request, we tell you the amounts actually received (Art. 45b VAG). The compensation for basic insurance remains with easyall. The Initial Information informs you about possible conflicts of interest (Art. 45a VAG).
2.3 Premiums are indicative values. The premiums and discounts displayed are calculations based on the tariff data available to us. Only the insurer's policy and contract terms are binding; deviations and errors excepted. Section 5.3 applies to the cashback displayed. In detail:
- Basic insurance premiums are based on the premiums for the respective year approved by the Federal Office of Public Health (FOPH). From these, we deduct the redistribution of environmental levies (Rückverteilung der Umweltabgaben) that the insurers deduct on the premium invoice. Our premiums may therefore differ slightly from the gross premiums published elsewhere (e.g. on priminfo.admin.ch).
- We calculate supplementary insurance premiums using the partner insurers' tariffs available to us. The insurers may change their tariffs. They decide themselves on reservations (Vorbehalte) and premium surcharges (section 4.5).
- We take family and combination discounts into account insofar as the insurers publish their rules on them. Discounts whose amount the insurer does not publish are not included in the price displayed. The discount according to the policy is authoritative.
2.4 No complete market coverage. Our comparison does not cover the entire market. We compare and broker supplementary insurance only for our partner insurers. In basic insurance, too, some health insurers are currently not included in the comparison. We do not accept applications to your current insurer or to a company of the same insurance group (section 5.9). Our recommendation relates only to the products included in the comparison.
2.5 Recommendation. easyall produces the recommendation from your details and the recorded product and benefit data, according to fixed rules for which easyall is responsible. Neither the compensation we receive from the insurers nor the cashback is factored into the recommendation or into the sorting of the comparison (by premium or, if you choose, alphabetically). The decision is yours.
2.6 Doctor search. The directory in the doctor search is based on the network data of a single insurer and serves only as a directory of names and addresses. It may be outdated or incomplete and says nothing about whether the insurer you have chosen recognises a practice for your insurance model. The insurer checks this; its current directory is authoritative. Before choosing a family doctor or HMO model, please check with the insurer and with the practice whether the practice is recognised for your model and will accept you as a patient.
3. Use of the platform
3.1 Use without an account. You can use the comparison calculator and the guides without registering.
3.2 Customer account. You need a customer account for applications, cashback and the referral programme. Provide truthful information when registering, keep it up to date and treat your login credentials as confidential. Only one customer account per person is permitted. If you suspect misuse of your account, please inform us immediately at info@easyall.ch.
3.3 Obligations when using the platform. In particular, you undertake:
- not to provide false or misleading information;
- not to misuse the platform, for example with false identities, with attempts at manipulation or by circumventing security measures;
- not to carry out automated access (e.g. scraping or bots) without our written consent;
- not to infringe the rights of third parties.
3.4 Data retrieval and protection against misuse. The comparison data on the platform (premiums, products, benefit descriptions and texts) are intended for your personal use. The following are prohibited without the written consent of easyall:
- automated bulk retrieval;
- systematic copying and extraction (scraping);
- the use of these data for competing services or for training AI models.
To protect the platform, we limit the number of requests and detect and block automated access. We may serve marked test data in response to automated access. easyall reserves all rights under the Federal Act against Unfair Competition (UWG, in particular Art. 5 let. c) and under the Copyright Act (URG).
You may reuse the canton table of basic insurance premiums at easyall.ch/praemien/kantone (including the CSV download) under the Creative Commons Attribution 4.0 International licence (CC BY 4.0), provided that you credit the source as “Source: easyall.ch”.

3.5 AI assistants and policy import.
- The chat assistant and the companion “easy” are AI-supported assistants. They help you use the platform, can answer questions about products and premiums and can explain easyall's recommendation. Their answers may be incomplete or incorrect.
- The assistants are not intended for legal, tax or medical advice.
- easyall produces the recommendation according to its own rules (section 2.5). easy changes your selection only if you click to do so.
- Please check values read from an uploaded policy before you adopt them. Check all details in the application before signing.
- The insurer's contract documents, the policy and the advisory record are binding.
- You answer the health questions, sign and provide the payment details yourself, never an AI. Please do not enter any health information in the chat.
- It is prohibited to manipulate the assistants or to query them by automated means.
- The assistants use language models of our service provider Anthropic. The Privacy Policy explains how data is processed in this context.
- Section 8 applies to liability.
4. Insurance intermediation
4.1 Status. easyall is registered with the Swiss Financial Market Supervisory Authority FINMA as an untied insurance intermediary (register no. F01522147). We are not tied to any insurer and are in a fiduciary relationship (Treueverhältnis) with you as the policyholder (Art. 40 para. 2 VAG).
4.2 Intermediation mandate. By submitting an application, you instruct easyall:
- to review the application and forward it with the necessary documents to the chosen insurer (section 4.4);
- to follow the application through until the insurer's decision and keep you informed of its status;
- at your request, to terminate your current insurance (section 7).
The provisions on the simple agency contract (einfacher Auftrag; Art. 394 et seq. of the Code of Obligations, OR) apply in addition. The mandate is free of charge for you.
4.3 Application process. An application on the platform proceeds in these steps:
- You select the desired products in the comparison.
- You enter the details of all persons to be insured. For supplementary insurance, you answer the insurer's health questions. You upload the necessary documents or, where the insurer permits this, submit them later (section 4.8).
- Before signing, you receive the Initial Information under Art. 45 VAG and the insurer's contract documents, in particular the general insurance conditions, and confirm receipt.
- On the overview, you check all details and can correct them. If the calculated premium changes before submission, we show you the new premium and you sign again.
- You approve the advisory record, accept these GTC, take note of the Privacy Policy and give the necessary consents. If you registered via a referral, you also accept the terms of the referral programme (section 6.5).
- You and all adult co-insured persons sign digitally (section 4.9).
- You submit the application. You then receive an acknowledgement of receipt by email; you can see the status in your customer account.
You can cancel at any time until submission. We do not forward a saved draft to insurers. We do not store health information in a draft; if you resume a draft, you answer the health questions again.
4.4 Review and forwarding. Before forwarding, we check your application for completeness. The review is carried out by a person registered with FINMA or under their responsibility. We usually record it in an addendum to the advisory record, which you will find in your customer account. We do not carry out a risk assessment; that is a matter for the insurer. We then forward the application via the channel the insurer provides, for example via its intermediary portal or by email. In doing so, the insurer receives the details and documents it requires for reviewing the application, in particular:
- the application details;
- for supplementary insurance, your health information (health declaration);
- the uploaded documents, e.g. copies of IDs and policies;
- depending on the insurer, the signatures and our advisory record or the insurer's record form.
4.5 Conclusion of the contract. The insurance contract is concluded exclusively between you and the insurer, and only when the insurer accepts your application. easyall is not a party to the contract. In basic insurance, the insurer must accept every person subject to compulsory insurance within its local area of activity (Art. 5 let. i of the Health Insurance Supervision Act, KVAG); regarding outstanding payments to the current insurer, see section 7.3. The insurer decides freely on applications for supplementary insurance, including on reservations and premium surcharges.
4.6 Your details. You are responsible for the accuracy and completeness of your details in the application. This also applies to details about co-insured persons and in particular to the health questions for supplementary insurance.
- If you conceal or incorrectly state a material risk factor (erhebliche Gefahrstatsache) about which the insurer asked, the insurer may terminate the supplementary insurance within four weeks of becoming aware of it.
- If it terminates, its obligation to pay benefits also lapses for losses that have already occurred, insofar as this fact influenced their occurrence or extent. It may reclaim benefits already paid for them (Art. 6 VVG).
- If the breach concerns only one of several insured persons, the contract may remain in force for the other persons (Art. 7 VVG).
If you notice an error after submission, please report it to us immediately at info@easyall.ch; we will forward the correction to the insurer.
4.7 Advisory record and activity log. easyall creates an advisory record for each application. You approve it digitally before submission and will then find it in your customer account. In addition, easyall keeps an internal activity log of your inputs and interactions on the platform (comparison calculator, policy import, easy, chat assistant, application form). Of our records, the insurer routinely receives at most the advisory record. We disclose extracts from the activity log only if we are obliged to do so, for example in the event of a complaint or spot check under the health insurers' industry agreement (Branchenvereinbarung), or if this is necessary to protect our rights. You can request the activity log for your application at any time at info@easyall.ch.
4.8 Documents and deadline. For the intermediation, we need, for each person to be insured, a copy of their ID and – in the case of a switch – of their current policy. We need the copy of the policy to check your existing cover, to prepare the termination letter and so that the new insurer can review the application. If the insurer requires certain documents already with the application, upload them before submission. If you did not upload these documents when submitting, please upload them to your customer account within 7 days; we will remind you of this by email. If the insurer subsequently requests further documents, we will inform you of this and of any deadline; please submit these documents promptly.
As long as documents are missing, we cannot fully process the application. As a rule, we forward it only once the documents are available, and only then do we send the notice of termination for your current insurance. Please note the notice periods: for a switch of basic insurance on 1 January, the notice of termination must reach the current insurer by 30 November at the latest (section 7.3). Therefore, submit missing documents as early as possible. If time until 30 November is running short, we will point this out to you. You can then also terminate your current insurance yourself; please let us know if you do so.
If the documents are not complete 30 days after submission, we close the application without forwarding it to the insurer and inform you by email. You can submit a new application at any time.
easyall is not responsible for disadvantages that arise because you submit documents not at all, incompletely or late, for example a missed termination date or the closing of the application. This is without prejudice to section 8.2.
4.9 Digital signature, co-insured persons and minors.
- a) You sign the application, the health declaration and any termination letters on the platform with a signature that you draw with a mouse or finger. The time of submission is decisive. You acknowledge this digital signature as binding and authorise easyall to affix it to these documents. It is not a qualified electronic signature within the meaning of Art. 14 para. 2bis OR. If an insurer requires a handwritten signature, we will inform you; your cooperation is then required.
- b) The applicant must be of age and capable of judgement. Each adult co-insured person signs personally and thereby makes their own declarations (consent for their health information and, if chosen, mandate and power of attorney for the termination of their current insurance).
- c) For minor children, the applicant signs as legal representative. The applicant confirms that they hold parental responsibility and, in the case of joint parental responsibility, are acting in agreement with the other parent. A person is a minor if they have not yet reached the age of 18 on the day of submission.
- d) You can also submit an application only for your minor child or only for your minor children. In that case, you as the parent are the applicant without being insured yourself, and you sign for the children as their legal representative (letter c).
- e) Anyone who provides details about other persons ensures that these details are correct and complete. He or she informs the persons concerned that their details will be passed on to easyall and to the insurer (see Privacy Policy).
4.10 Right of revocation for supplementary insurance. You may revoke an application for supplementary insurance within 14 days of making it. The revocation must be made in writing or in another form that allows proof by text (e.g. by email). The deadline is met if you notify the insurer of the revocation or hand it over to the post office on the last day of the period (Art. 2a VVG).
- Address the revocation directly to the insurer and please send us a copy promptly at info@easyall.ch.
- If you send the revocation only to us, we will forward it promptly to the insurer. However, the notification to the insurer remains decisive for the deadline.
- No cashback arises after a revocation (section 5.4).
- If we learn of your revocation before the notice of termination is sent, we will not terminate your current supplementary insurance. So that a revocation can still be taken into account, we send this notice of termination only after the revocation period and a few additional days for postal delivery have expired (section 7.4).
- For the dispatch of this notice of termination and for the due date of the cashback, we calculate the revocation period, as a precaution, from the day on which we forward your application to the insurer and add three days for postal delivery.
- This right of revocation does not apply to basic insurance. If you revoke the supplementary insurance, this has no effect on the switch of your basic insurance.
4.11 Revocation of the mandate. You may revoke the intermediation mandate and the power of attorney for the termination at any time, for example by email to info@easyall.ch (Art. 34 and 404 OR).
- If your application has not yet been forwarded to the insurer, we will no longer forward it.
- If it has already been forwarded, we will, at your request, inform the insurer that you are withdrawing the application. Whether this is still possible depends on insurance law and on the insurer's decision (for supplementary insurance, see section 4.10).
- We cannot withdraw a notice of termination that has already been sent.
The revocation is free of charge and does not in itself trigger a reclaim of cashback.
5. Cashback programme
5.1 Requirement and scope. If you take out supplementary insurance (VVG) through easyall, you receive a one-time cashback.
- We do not grant any cashback or other benefits of monetary value on basic insurance (KVG). The compensation for basic insurance (a maximum of CHF 70 per insured person) remains with easyall.
- The cashback does not require you to also switch your basic insurance through easyall. A switch of basic insurance has no effect on the cashback.
- The cashback is calculated per application from the supplementary insurance of all persons insured under the application. We credit it to the customer account of the applicant through which the application was submitted and pay it out to the applicant. This also applies to the portion attributable to the supplementary insurance of co-insured persons. Adult co-insured persons agree to this and confirm it with their signature in the application; any division among those involved is a matter for them. Any reclaim (sections 5.6 and 5.7) is addressed to the applicant.
5.2 Amount. The cashback amounts to 40% of the acquisition commission that easyall receives from the insurer for the supplementary insurance brokered, after a flat deduction of 10% of this commission for cancellation risk (the risk that the insurer reclaims commission). Example: if the commission is CHF 1'000, the cashback is CHF 360 (CHF 1'000 less the flat deduction of 10% gives CHF 900; 40% of that).
- The commission is determined by easyall's agreement with the insurer. It is based on the supplementary insurance premium that the insurer invoices, after deduction of any family or combination discounts.
- With some insurers, a lower rate or a maximum amount applies. The cashback is then lower or may not apply at all. The amount we show you before submission already takes this into account (section 5.3).
- The flat deduction of 10% is final. It applies regardless of whether and when an insurer actually reclaims commission, and it is not paid out subsequently.
5.3 Amount displayed and adjustments. Before you submit your application, we show you the cashback for your application. This amount displayed is authoritative. Subsequent changes to our cashback conditions apply only to future applications.
The amount displayed is based on the supplementary insurance premium calculated in the comparison. Until payout, we adjust it only in the following cases, in each case on the same conditions:
- The supplementary insurance premium according to the policy differs from the calculated premium, for example because of a premium surcharge, a discount that the insurer does not publish, a different product or only partial acceptance. If the premium is higher, the cashback increases; if it is lower, the cashback decreases.
- The insurer pays no commission or a lower commission for this contract because details in the application were incorrect or incomplete (section 5.7) or because an insured person was already insured with it or with a company of the same insurance group (section 5.9).
The correction of obvious calculation or display errors remains reserved (cf. Art. 24 para. 3 OR). You can see every adjustment in your customer account. After payout, the amount is final; reclaims under sections 5.6 and 5.7 remain reserved.
5.4 Due date. The cashback becomes due 15 days after the start of the supplementary insurance according to the policy if at that time:
- the insurer has accepted the application and the supplementary insurance is in force,
- the revocation period under Art. 2a VVG, calculated from the forwarding of your application to the insurer and including postal delivery, has expired (section 4.10), and
- you have not revoked your application.
If these conditions are met only later, the cashback becomes due as soon as they are met. If the insurer rejects the application or you withdraw or revoke it, no cashback arises.
5.5 Payout. We currently pay out the cashback exclusively by bank transfer to an account in Switzerland (IBAN with country code CH) held in your name. We currently do not offer any other payout methods.
- You enter the IBAN in your customer account. You are responsible for ensuring that it is correct and that the account is held in your name.
- If we transfer to the IBAN you have entered, easyall has fulfilled its payment obligation. This does not apply if we should have recognised that the information was incorrect.
- We transfer amounts due to your account within 30 days of the due date. As long as you have not entered an IBAN, the amount due remains credited in your customer account, and we point this out to you there. We pay it out within 30 days after you have entered an IBAN.
- The claim becomes time-barred in accordance with the statutory provisions, i.e. ten years after the due date (Art. 127 and 130 OR).
5.6 Reclaim if the insurance ends within two years. If the supplementary insurance taken out through easyall ends before two years have elapsed since its start, for example because you or a co-insured person terminate it or switch to another insurer, easyall may reclaim the cashback paid out for it as follows:
- if it ends within the first year after its start: 100%;
- if it ends in the second year: 50%.
If the supplementary insurance ends only in part (e.g. for individual products or persons), this applies to the corresponding part of the cashback.
There is no reclaim:
- insofar as the supplementary insurance ends because of the death of an insured person;
- if the insurer ends the contract for reasons for which neither you nor a co-insured person is responsible.
Reasons for which you are responsible include in particular a breach of the duty of disclosure (Art. 6 VVG) and default in payment. If the supplementary insurance has existed for at least two years, a reclaim because of its ending is excluded.
5.7 Further grounds for reclaim, time limits and set-off.
- easyall may also reclaim cashback paid out insofar as it is based on incorrect or incomplete details in the application for which you are responsible under section 4.6. This applies in particular if the insurer pays no commission for the contract, or reclaims it, because an insured person was already insured with it or with a company of the same insurance group (section 5.9).
- If you still effectively revoke your application after the payout (Art. 2a VVG), you repay the cashback.
- Any reclaim is limited to the amount paid out.
- easyall asserts a reclaim within 12 months of learning of the ground for the reclaim (for section 5.6: of the ending of the supplementary insurance). In addition, easyall asserts a reclaim under section 5.6 no later than four years after the start of the supplementary insurance.
- You repay a reclaimed amount within 30 days of our written request; an email is sufficient.
- easyall may set off reclaims against your other credit balances with easyall, in particular against cashback or referral bonuses that are due.
- The following do not in themselves trigger a reclaim: a revocation of the intermediation mandate (section 4.11), the deletion of your customer account and a switch of your basic insurance.
5.8 Taxes and confirmation. In your customer account, you can download each year a confirmation of the amounts paid out in the calendar year. The tax treatment of cashback and referral bonuses is your responsibility and depends on your personal circumstances. easyall does not provide tax advice.
5.9 Existing insurance. The platform does not accept applications to the insurer with which you are already insured according to your details, or to a company of the same insurance group (e.g. Galenos or sana24 in the Visana Group, Avenir or Philos in Groupe Mutuel), because insurers generally pay no commission for these. For changes to your insurance, please contact your insurer directly. If it subsequently turns out that an insured person was already insured with this insurer or this group, and the insurer therefore pays no commission, the cashback lapses to that extent (sections 5.3 and 5.7).
5.10 Misuse. In the event of misuse of the cashback programme, for example through false information or sham applications, the cashback lapses. We may reclaim amounts already paid out.
5.11 Changes. easyall may change the cashback conditions for future applications (section 11). Section 5.3 applies to applications already submitted.
6. Referral programme
6.1 Participation. With your customer account, you receive a personal referral link and a referral code. You can use them to recommend the easyall.ch platform.
6.2 Attribution. A referral is taken into account only if the referred person uses your link or enters your code when registering. Subsequent attribution is not possible, including for persons who already have a customer account.
6.3 Referral bonus. For each referred person, at most one referral bonus arises, namely from the first application accepted by the insurer for which the referred person receives cashback.
- The bonus amounts to a maximum of 10% of this cashback and follows its adjustments.
- We set the rate per insurer. For some insurers, a lower rate may apply or the bonus may not apply.
- If the referred person receives no cashback, for example because they switch only their basic insurance, no referral bonus arises.
6.4 Due date, payout and reclaim. The referral bonus becomes due when the referred person's cashback becomes due (section 5.4). Sections 5.5 to 5.8 apply accordingly to payout, reclaim, set-off and taxes. If the referred person's cashback is reclaimed in whole or in part, easyall may reclaim the referral bonus in the same proportion.
6.5 What the referring person sees; consent of the referred person. In their customer account, the referring person sees for each referred person only the first name and the date of registration. They see their referral bonuses on the cashback page only as totals (“pending” and “paid out”), never broken down by person. In the customer account, we do not display amounts, status or cancellations for individual referred persons. In emails about the release or payout of an individual referral bonus, the referring person can see its amount, but not the name of the referred person.
The referring person does not see the referred person's insurer, products, premiums, cashback or health information. However, because the bonus is a share of the referred person's cashback, the referring person can, if they have referred only a few persons, infer the amount of that cashback from the total or from such an email.
Anyone who has registered via a referral link or referral code accepts the terms of the referral programme under this section 6 when submitting the application. We store this consent with the application.
6.6 No insurance intermediation. The referring person does not engage in insurance intermediation. They recommend exclusively the easyall.ch platform, do not advise the referred person and do not broker any insurance. Comparison, information, the Initial Information under Art. 45 VAG and the processing of applications are carried out exclusively by easyall GmbH as a registered untied insurance intermediary. The referral bonus is consideration for recommending the platform and not compensation for an intermediary activity.
6.7 Prohibited conduct. It is not permitted:
- to refer yourself;
- to open several customer accounts;
- to use false identities;
- to distribute referrals as unsolicited bulk advertising (spam).
In these cases, we may exclude you from the referral programme. A referral bonus based on such conduct lapses or may be reclaimed. The referral bonus is personal and not transferable.
6.8 Changes to the programme. easyall may change or end the referral programme with effect for the future (section 11). The previous conditions apply to the referral bonus from an application that the referred person submitted before the change.
7. Termination service
7.1 Mandate and power of attorney. If you choose in the application that easyall should terminate your current basic and/or supplementary insurance, you instruct and authorise easyall, for yourself and, as legal representative, for your minor children:
- to prepare the termination letters in your name from your application details;
- to affix to them your digital signature given in the application;
- to date the letters on the day of dispatch;
- to transmit them to your current insurer;
- to receive a copy of the confirmation of termination.
Adult co-insured persons give the mandate and power of attorney for the termination of their own current insurance themselves, with their own digital signature in the application; easyall then affixes their signature to their termination letter.
The termination service is free of charge. You can also carry out the termination yourself; please let us know if you do so.
7.2 Dispatch. Depending on the situation, we transmit the notice of termination to your current insurer electronically (e.g. by email or via a channel that the insurer provides for this purpose), by post (usually by registered mail) or by hand delivery. We do not commit to any particular method of dispatch.
We document the dispatch with the date and method of dispatch and keep a copy of the letter sent. What is decisive for the deadline is when the notice of termination reaches the current insurer, not the postmark.
7.3 Basic insurance. We send the notice of termination for basic insurance regardless of the decision on any supplementary insurance and without waiting for the revocation period, because the new basic insurer must accept you (section 4.5). As a rule, we send it only once the new insurer has accepted your application for basic insurance in writing and the necessary documents are available (section 4.8), and we make sure that it reaches the current insurer in time wherever possible. If documents are missing and time until the arrival deadline is running short, we will point this out to you; you can then also terminate your current basic insurance yourself.
- Switch on 1 January: the notice of termination must have reached the current insurer by 30 November at the latest. If this day falls on a Saturday or Sunday, please plan for the last working day before it.
- Switch on 1 July: the notice of termination must have arrived by 31 March at the latest (Art. 7 para. 1 and 2 KVG). This switch is only possible under certain conditions, for example with the ordinary deductible and in the standard model.
- The existing insurance relationship ends only when the new insurer has notified the current insurer that you are insured without interruption (Art. 7 para. 5 KVG).
- If there are outstanding amounts with your current insurer for which reminders have been sent (premiums, cost-sharing, default interest or debt collection costs), the termination becomes effective only if these outstanding amounts have been paid in full by the end of the notice period (Art. 64a para. 6 KVG, Art. 105l of the Health Insurance Ordinance, KVV).
7.4 Supplementary insurance. If you apply for new supplementary insurance through easyall, we send the notice of termination for your current supplementary insurance only once:
- the new insurer's written acceptance confirmation is available and
- the revocation period under Art. 2a VVG has expired, plus a few days for postal delivery (for the calculation, see section 4.10).
If the new insurer rejects your application, we do not terminate your current supplementary insurance; the same applies if you revoke your application and we learn of this before dispatch (section 4.10).
If you do not apply for new supplementary insurance, we send the notice of termination after receipt of your application and the necessary documents (section 4.8). Please note: if you terminate supplementary insurance without new cover, you may later be able to take it out again only after a health check, with reservations or not at all.
Notice periods and minimum terms are governed by the conditions of your current insurer and by Art. 35a VVG.
7.5 Next possible date. If a termination can no longer take effect on the desired date, it applies to the next possible date; this is also stated in the termination letter. This can happen, for example, if the new insurer's acceptance confirmation arrives late or documents are missing. Until the next possible date, premiums may be payable for the current and the new insurance at the same time. If we realise that the desired date cannot be met, we will inform you where possible.
7.6 Handwritten signature. If your current insurer requires a notice of termination or power of attorney signed by hand, we will inform you. Your cooperation is then required: for example, you print out the letter, sign it and send it to us or to the insurer. This may delay the termination.
7.7 Your cooperation. So that we can terminate in time, your details must be correct (current insurer, policy numbers, desired date) and the necessary documents must be available in time (section 4.8). Please forward to us promptly any letters from your current insurer concerning the termination, and check the confirmation of termination.
7.8 Revocation of the power of attorney. You may revoke the mandate and the power of attorney for the termination at any time (section 4.11). We cannot withdraw a notice of termination that has already been sent. Whether your current insurer agrees to a withdrawal is for it to decide.
7.9 Responsibility. easyall is not responsible for missed deadlines that are attributable to:
- incorrect, incomplete or late details or documents from you or from co-insured persons;
- a late acceptance confirmation from the new insurer for which easyall is not responsible;
- a necessary handwritten signature, if we informed you in good time (section 7.6);
- a lack of cooperation.
Otherwise, section 8 applies.
8. Liability
8.1 Principle. easyall is liable to you in accordance with the statutory provisions for the faithful and diligent performance of the intermediation and of the termination service (Art. 398 OR). Professional indemnity insurance covering financial losses arising from the intermediation activity is in place (Art. 41 para. 2 let. d VAG).
8.2 Intent and gross negligence. easyall is liable without limitation for damage that easyall or its auxiliaries cause intentionally or through gross negligence.
8.3 Circumstances beyond our control. easyall is not liable for damage insofar as it is attributable to the following:
- decisions of the insurers, for example the rejection of an application, reservations, premium surcharges, premium or tariff changes and benefit decisions;
- incorrect or outdated premium, product or benefit data originating from insurers, the FOPH or other third parties, provided that easyall adopted them with due care and the error was not recognisable to easyall;
- incorrect, incomplete or late details, documents or acts of cooperation by you or by co-insured persons;
- delays in delivery by the post or other transmission services, if easyall dispatched in good time;
- temporary interruptions or disruptions of the website, provided that easyall exercised the customary care.
Section 8.2 remains reserved in all these cases.
8.4 Displayed values. If the premiums or discounts displayed differ from the policy, this does not in itself give rise to any claim against easyall. The policy is authoritative for your insurance cover and your premium (section 2.3). Sections 5.2 and 5.3 apply to the cashback.
9. Intellectual property
The content of the website is protected by the rights of easyall or of the respective rights holders, in particular texts, graphics, logos, software and compilations of data. Third-party content remains the property of the respective rights holders, for example the insurers' logos, names and conditions. Without the written consent of easyall, you may use the content only for your personal use. The licence for the canton table (section 3.4) and mandatory statutory rights of use remain reserved.
10. Data protection
10.1 You can find out how we process personal data in our Privacy Policy. It informs you in accordance with the Federal Act on Data Protection (DSG) and is not part of these GTC. We obtain consents, for example for the processing of health information, separately in the application. We process the health information in the application only for that application and only with your express consent, which you give when submitting it.
10.2 We do not ask for the AHV number (Swiss social security number). If an insurer needs it, it can ask you for it directly.
10.3 Section 6.5 governs which information a referring person sees about you.
11. Changes to the GTC
11.1 easyall may change these GTC, for example in the event of new or changed services, changed legal or regulatory requirements or changed agreements with insurers.
11.2 We publish amended GTC on easyall.ch; they apply from their publication to the further use of the platform and to new applications. We inform you of material changes in an appropriate form, for example with a notice on easyall.ch. If you do not agree with a change, you may terminate your customer account free of charge at any time (section 12).
11.3 For applications that you submitted before the change takes effect, the version you accepted when submitting applies; this also applies to the cashback from these applications. We also apply to earlier applications any rules of a newer version that are exclusively in your favour (for example the due date under section 5.4). Reclaim rules under section 5.6 apply only to applications submitted under this version. For new applications, you accept the version then in force.
11.4 Earlier versions of these GTC are available on request at info@easyall.ch.
12. Customer account: termination and deletion
12.1 Termination by you. You may terminate your customer account at any time and request its deletion. To do so, send an email to info@easyall.ch, please from the email address stored in your account.
12.2 Deletion and retention. After termination, we generally delete or anonymise, within 30 days, your login credentials and the account details that we no longer need. We retain information on submitted applications, on terminations and on cashback and referral transactions as long as a statutory retention obligation exists or we need it as evidence. Instead of deleting it, we then block it for other purposes. Details can be found in the Privacy Policy in the section “Retention period”.
12.3 Ongoing mandates. The termination of the account does not affect intermediation and termination mandates that you have already given, unless you expressly revoke them (section 4.11).
12.4 Outstanding credit balances. We pay out cashback and referral bonuses that are already due or become due later in accordance with section 5.5 even after the termination of your account; for this purpose, please provide us with an IBAN. Rights of reclaim under sections 5.6 and 5.7 remain in place.
12.5 Blocking by easyall. If you breach these GTC, in particular through misuse (sections 3.3, 5.10 and 6.7), easyall may block or terminate your account. Claims that have already arisen and are not based on the breach remain in place. We will inform you about ongoing applications.
12.6 Inactive customer accounts. We may delete a customer account through which you have not submitted an application if you have not signed in for 24 months. We announce any such deletion 30 days in advance by email; if you sign in during this period, the account is retained. An account with an outstanding credit balance or with a referral from which a referral bonus may still arise is not deleted.
13. Final provisions
13.1 Swiss law applies.
13.2 The place of jurisdiction is Solothurn. Mandatory statutory places of jurisdiction remain reserved, in particular the place of jurisdiction of consumers at their domicile (Art. 32 and 35 of the Civil Procedure Code, ZPO).
13.3 Should individual provisions of these GTC be invalid, this does not affect the validity of the remaining provisions.
13.4 These GTC are available in several languages. In the event of discrepancies, the German version prevails.
